Enrolled Agents and Accountants, like all other providers of personal financial services, are now required by law to inform their clients of their policies regarding privacy of client information. This includes notifying clients of how we collect, share, and protect all personal information. We have been and continue to be bound by professional standards of confidentiality that are even more stringent than those required by law. Therefore, we have always protected your right to privacy. Please read this notice carefully to understand what we do.

Information You Provide to Us

You may provide us with your personal information as follows:

  • Identity verification information. We collect information to verify your identity including your name, date of birth, social security number, driver’s license number, passport number, government-issued identification details, and similar information to verify your identity and to help you file your tax returns.
  • Business and financial information. We may receive information about your business, your finances, expenses, invoices, financial statements, details of your financial transactions, payroll details, payment details, tax return details, details about your customers/vendors/employees, income and wage information, and/or investment information.
  • Marketing data. You may provide us with your contact information and preferences for receiving our marketing communications.
  • Contact data and account profile data. We collect information when you or your organization create an account and/or upload information to the client portal. Personal information may include your name, previous names, professional title and company name, education, billing and mailing addresses, phone number and email address, billing information, demographic information, preferences, and account credentials.

How We Use Your Personal Information

We may use your personal information in multiple ways at the time of collection:

  • Run and manage our business, including resolving billing and financial disputes.
  • Provide a product or service to you that you requested.
  • Communicate with you, such as sending you electronic notifications concerning your financial privacy.
  • Provide you with support and resolve disputes.
  • Authenticate your identity.
  • Compliance and protection:
    • Comply with legal and regulatory requirements;
    • Prevent fraudulent or illegal activity; and
    • Exercise our rights during judicial, administrative, or arbitration proceedings.
  • With your consent.

How We Share Your Personal Information

We may share your personal information in the following circumstances:

  • When you publicly post the information. We provide the opportunity for you to publicly post reviews, questions, comments, suggestions, or other content that may include personal information, such as your name.
  • For legal reasons. We may share your personal information with third parties for legal reasons without your consent, and as permitted by law, including:
    • When we reasonably believe disclosure is required in order to comply with a subpoena, court order, or other applicable law, regulation, or legal process;
      • To protect or defend against attacks;
      • To prevent fraud, cybersecurity attacks, or other illegal activity; and
      • With regulatory agencies, including government tax agencies, as necessary to help detect and combat fraud and/or protect our customers, users, and/or company.

Protecting the confidentiality and Security of Client Information

Unless you specifically ask us to delete your personal information, we retain records relating to the professional services we provide so that we are better able to assist you with your professional needs and to comply with professional guidelines. Even if you submit a deletion request, we may be required to maintain your personal information for as long as necessary to:

  • Comply with our legal or regulatory compliance needs;
  • To exercise, establish, or defend legal claims, and/or
  • To protect against fraudulent or abusive activity on our service.

When this is the case, we will take reasonable measures to securely isolate your personal information from any further processing until we are able to delete it.

Security of Your Personal Information

To guard your personal information, we maintain physical, electronic, and procedural safeguards that comply with our professional standards. However, despite these controls, we cannot completely ensure or warrant the security of your personal information.

Changes to Our Privacy Statements

We may change or update our privacy statement at any time. If we make material changes to the way we process your personal information, we will notify you by posting a notice in the client portal, by sending you a notification, or by other means consistent with applicable law.

IRS Section 7216 Regulations

Internal Revenue Code §7216 is a criminal provision enacted by the U.S. Congress in 1971 that prohibits preparers of tax returns from knowingly or recklessly disclosing or using tax return information. A convicted preparer may be fined not more than $1,000 or imprisoned not more than one year or both, for each violation. Internal Revenue Code §6713, the companion civil penalty, imposes a $250 penalty on a preparer for each prohibited disclosure or use of the return information.

Because of these rules, we do not provide copies of tax returns to banks or any other third parties who may need a copy of your return if we have not received a proper disclosure form.
